PERSONAL DATA PROTECTION CLARIFICATION TEXT

Dr. Fatma Horasan's Clinic (“Clinic”) is committed to ensuring the security of your personal data with the utmost sensitivity. With this awareness, we place great importance on processing, storing, and deleting the special and general personal data of all candidates applying to work at the Clinic in accordance with Law No. 6698 on the Protection of Personal Data (“Law”), secondary regulations issued and to be issued under the Law (regulations, communiqués, guidelines), and decisions made or to be made by the Personal Data Protection Board. As a “Data Controller” as defined in the Law, we process your personal data in the manner explained below and within the limits prescribed by the legislation.

Information About the Data Controller

The data controller is Dr. Fatma Horasan's Clinic, registered with the İzmir Trade Registry Office under number … and MERSİS number …, located at “[Şair Eşref Bulvarı Şair Apt. No:82/1 K.2 D.5 Alsancak – İzmir]”.

Purposes of Processing Personal Data

Your personal data is processed by the Clinic for the following purposes:

To fulfill our obligations specified in Law No. 6698 and secondary regulations issued under this Law.
To develop and maintain human resources policies.
To evaluate and conclude your job applications.
To contact you again if your application is successful.

Your personal data is processed in a legal, fair, and always relevant, limited, and proportionate manner within the limits specified by the Law and for these purposes.

Transfer of Personal Data

Your personal data, for the purposes mentioned above, is transferred to the Clinic's human resources department in accordance with the conditions specified in Articles 8 and 9 of the Law.

Methods and Legal Grounds for Collecting Personal Data

Your personal data is collected through automatic and non-automatic methods, orally, in writing, or electronically, using means such as email, phone, website, and paper forms.

In this scope, personal data such as name-surname, nationality, place and date of birth, gender, marital status, driver's license, photo, educational background, military status document for male employees, work permit document for foreign personnel, phone number, email address, camera recordings for monitoring workplace entry and exit, and security control records are processed based on legal grounds such as the legitimate interests of the Clinic, as specified in Articles 5(2/a-c-ç-e-f) and 6(3) of the Law, provided that they do not harm your fundamental rights and freedoms.

If your job application is not deemed suitable as of the evaluation date, your data may be processed for a period of 1 year with your explicit consent under Article 5(1) of the Law, for the purpose of re-evaluation in case of future employment needs. At the end of this 1-year period, during the first periodic destruction period following the expiry date, your personal data processed within the scope of the job application will be automatically deleted, destroyed, or anonymized.

Rights of Data Subjects Under the Law

You have the right to:

Learn whether your personal data is processed, its processing purpose, and whether it is used in accordance with its purpose, and if processed, request information about it.
Learn about third parties to whom your data has been shared within Turkey and abroad, in accordance with the Law.
Request correction of any incomplete or incorrect personal data.
Request deletion or destruction of your personal data within the framework of the conditions specified in Article 7 of the Law.
Request that third parties to whom your data has been transferred are notified of your requests for correction and deletion.
Object to any outcome arising from the automatic processing of your data, which may be detrimental to you.
Request compensation for damages if you believe that your data has been recorded or used unlawfully and you have suffered damage as a result.

If fulfilling your request incurs additional costs, you will be required to pay the fee determined by the Communiqué on Principles and Procedures for Application to Data Controllers issued by the Personal Data Protection Board. No fee will be charged for the first 10 pages of written responses, but a fee of 1 TL per page will apply for pages exceeding 10. If the response is provided on a record medium such as CD or flash drive, the cost of the record medium will be reflected to you.

Your requests will be evaluated and concluded as soon as possible and within a maximum of 30 (thirty) days depending on the nature of the request.

To exercise your rights under the Law, you can submit your requests in writing in Turkish to the Clinic or visit the Personal Data Protection Authority's website for detailed information.

You can make your requests by:

Filling out the form available at www.drfatmahorasan.com and sending a signed copy either in person or via notary to “[Şair Eşref Bulvarı Şair Apt. No:82/1 K.2 D.5 Alsancak – İzmir]”
Sending it via the registered email address on file with the Clinic.

In your request, you need to clearly and understandably state the nature of the request and provide a notarized special power of attorney if acting on behalf of someone else.

Applications must include name-surname, signature, T.C. identity number, address of residence or workplace, email address, phone and fax numbers, and subject of the request as required by the Communiqué on Principles and Procedures for Application to Data Controllers. Applications lacking these elements will be rejected by the Clinic.

The Clinic reserves the right to amend this clarification text for reasons arising from the Law, secondary regulations, and Board decisions. Any changes or updates to this text will become effective as of the date they are communicated to you.
